Introduction of the Third-party evaluation

   2010 July 8th, the Beijing Housing and Construction Committee has issued the "Management of Third Party evaluation of Property Service" for regulation of property service activities, and build a quality equal price market system, and effective from october 1st. 
   Through the early-stage investigation, we find out that lots of owners have the same experience: after you purchase a new house, it's all up to the developer or the property company that how much you should pay for the service, it's all on the contract no room for negotiation, if there is quality problem with the house or public facilities are being taken, choatic parking, bad order, securities voilance, or disturbance in the basements, etc, they often have different sides. And if the conflict escalate, the most usual way is to go to the government officials or judges to decide, but they are not professional on this, so the final decision is sometimes biased, how to avoid this situation?
   As the capital, Beijing is the first to introduce a third-party rating agencies, which means a radical change in property price formation mechanism, troubles of proper charges for residential property owners and property companies turned into a better way, and residential property costs are no longer determined by the developers rather calculated by the third party agency through a detailed assessment. Whenever one party out of owners or property companies wish to adjust property costs, third-party rating agencies will serve with an independent, objective and impartial attitude and the introduction of third-party assessment is for the market demand.
   So, who should be the third party? What qualifies a third-party rating agencies? Beijing clearly states: Assessment supervisory agency of property services should have independent legal personality, professional supervision in the assessment of property services business; and registered capital of 100 million yuan; with fixed office space and business facilities; more than 5 of fresh or intermediate professional Managers and technical personnel, and withholding recording certificate in Beijing Housing and Urban Commission. There are seventeen companies completing the record. Developers should set the standards before house selling, and then random choosing a third agency from the housing administration departments directory to estimate service fees, and publicize the results in the sales occasions and write into the early-stage of housing and property services contract.

   In the new regulations issued by the Beijing Housing and Construction Committee, the frictional issues will be delivered to the third party agency which is very sample significant. This not only open the new example for the whole country but also the best choice for property industries to develop into a mature market. According to the "Property Management Terms, Beijing Property Management Methods, Beijing Third Party Supervision Management Methods and Beijing Property Service Fee Evaluation Examples", the design path is practical and it will ease the conflict in property service industries, and the court will emphasize more on the third party in the future. 
 
   To ensure the impartiality of third-party rating agencies, adhering to relevant state laws, regulations and industry standardization requirements,  the feasibility assessment process, the authority of assessment criteria, cost estimates objectivity of property services should be emphasized to provide true and reliable legal basis for the economic behaviour within. At the same time, Beijing will also establish administrative departments of Housing Property Services experts. For business of property services experts should be selected from a pool of experts,contents of false, misleading statements or major omissions should not exist. Violation of rules receiving property or other benefits will be given a warning. In serious cases, property management industry expert qualification will be cancelled, and re-declaration of being an expert will not be possible.
    We all look forward to the introduction of third-party assessment bodies system and bring gradual growth to this new industry, and extending all over the country, for those agencies meeting the required third-party assessment criterion serve in a fair, equitable and open environment, achieving win-win in the harmonious interaction.
